Agreement

By signing up to be an Affiliate in the Early Care Evolution Affiliate Program (“Program”), you agree to be bound by the following terms and conditions (“Terms of Service”). Early Care Evolution reserves the right to update and change these Terms at any time without notice. Continued participation in the Program after any updates constitutes your agreement to those changes. Violation of these terms may result in immediate termination of your account and forfeiture of any unpaid commissions.

Account Terms for Eligibility

• You must be 18 years or older and reside in the United States to participate.
• Only human individuals may register; automated or “bot” accounts are prohibited.
• You must provide accurate and complete information, including your legal name, email address, and EIN or SSN for tax reporting.
• You are responsible for maintaining the security of your login credentials.
• Each person or business may maintain only one affiliate account.
• You may not use your affiliate link to purchase products for your own use.

Commission Structure

Affiliates earn commission based on their monthly referral performance:

Tier status is reviewed monthly, and upgrades or downgrades are based on total qualifying revenue during that period.

Payment Schedule

Commissions will be paid on the 1st and 15th of each month, with a minimum payout amount of $30.

Cookies and Data Retention

To improve your experience and track affiliate sales, we use cookies that help monitor and attribute sales activities. These cookies remain active on a user’s device for up to 45 days from the initial visit, after which they automatically expire. This means that any purchases made within this 45-day period will be credited to the original sales agent responsible for the referral. If a user returns after the 45-day period, a new cookie will need to be set to continue tracking.

Lifetime Customer Policy

Customers referred through your unique affiliate link will remain connected to your account for a period of three (3) years from their first purchase date.

You will continue to earn commissions on any purchases that customer makes within that three-year period. After the 3-year term, the customer will no longer be considered your lifetime customer unless referred again through your link.

Inactive Account Policy

To maintain the integrity of our program, affiliates must remain active.
If your account has no sales and no tracked referral visits within six (6) consecutive months, your account may be deactivated without notice.

Deactivated accounts:

• Forfeit any unpaid commissions under $25.
• May reapply to the Program at any time.

Reactivation is at the sole discretion of Early Care Evolution.

Referral Fees and Payments

• Commissions are paid only for purchases made directly through your tracked affiliate link.
• Payments are issued monthly once your balance exceeds $25.
• All commissions are calculated net of refunds and chargebacks.
• Payments are made via Zelle (or another approved method).
• You are responsible for providing an accurate payment email and tax identification.

Promotional Guidelines

You may use approved banners, graphics, and text links provided by Early Care Evolution.
You may not:

• Modify provided marketing materials.
• Use spam, misleading advertising, or paid search on our brand name.
• Misrepresent your relationship with Early Care Evolution.

Relationship of Parties

You are an independent contractor, not an employee or representative of Early Care Evolution. Nothing in this agreement creates a joint venture, partnership, or agency relationship.

Termination

Early Care Evolution reserves the right to suspend or terminate your account at any time for any reason, including:

• Fraudulent activity or self-referrals.
• Inappropriate or unethical marketing methods.
• Violation of these Terms of Service.

Upon termination, you must immediately remove all Early Care Evolution links, logos, and materials from your platforms.

Limitations of Liability

Early Care Evolution will not be liable for any indirect, special, or consequential damages (including loss of income or data). The total liability of Early Care Evolution under this agreement shall not exceed the total commissions paid to you in the preceding 12 months.

Disclaimers

We make no express or implied warranties with respect to the Program or any products sold. We do not guarantee uninterrupted operation or tracking and are not responsible for data loss or system errors.

Independent Investigation

By participating, you acknowledge that you have independently evaluated the Program and are not relying on any representation other than these Terms.

Governing Law & Dispute Resolution

This Agreement is governed by the laws of the United States. Any dispute arising from this Agreement shall be resolved through binding arbitration under the rules of the American Arbitration Association.

Miscellaneous

Failure by Early Care Evolution to enforce any right or provision in this Agreement does not constitute a waiver of such right.
This Agreement constitutes the entire understanding between the parties and supersedes all prior versions.
